What is Not Included in Utah Public Records?

When states decide what goes in their public records, the assumption is that everything in the government is included unless it needs to specifically be excluded. Utah public records take this stance. Everything in the state government is available for Utah public records unless the state itself decides to keep it out.

However, for the safety of those living in the state, much of the most personal information has been excluded from these public records. Some examples include:

  • Medical Histories - The state has decided that things like medical histories are private, and not something that should be included in public records.
  • Autopsy Photos - While criminal histories are often a part of public records, autopsy photos are considered a breach of privacy, so they are not included either.
  • Social Security Numbers - Social security numbers are too easy to abuse, so they are also not included within Utah public records.
  • The state itself decides on these exemptions. Anything that is not exempt, however, is automatically considered public record. While there is a great deal of information available in Utah public records, there is also some information that is going to be excluded for the safety and privacy of the people and businesses within the state.
