Understanding Montana Public Records Access

In general, it is the job of the government to make sure there are no legal loopholes or confusing legal language that may cause issues in the future. Although the laws themselves may often sound confusing at first glance, the language is designed to ensure there are no grey areas, because grey areas lead to lawsuits and scandals. Yet some states have set themselves up in strange ways that manages to still lead to confusing outcomes.

Montana public records are a great example. Each state is supposed to have a clear designation about who is allowed to access the state's public records. The Montana state law says that only those that live in the state of Montana can access their records. Yet the Montana constitution states that Montana public records must be available to anyone that request them, no matter where they may be from.

Which Rule Do You Follow?

According to our system of government, the constitution always outweighs the individual laws. So although there may be legal language that says only residents can access Montana public records, the constitution disagrees, and so the records must be made available to everyone. No matter what state you're from, you are supposed to be allowed access to Montana public records. If for any reason you get denied from these records, you will have the law on your side.
